“Us” and “We” means Forlan Networks Limited.
“You” means the consumer who accepts a quotation from us or whose order is accepted by us.
Should we provide any consultancy services including system design or installation, you shall be supplied with a separate copy of conditions relating to the services being provided.
Completing and submitting an electronic order form means you are making an offer to purchase goods, which, if accepted by us, will result in a binding contract. An acceptance email from us confirms that the contract is formed.
We endeavour to ensure the accuracy of information and prices on our website. However, we do not honour inaccurate or erroneous prices. Information on the site may occasionally contain technical inaccuracies or typographical errors (including pricing errors), and may be changed, updated or modified at any time and from time to time without notice. Our prices are subject to change without notice
Forlan Networks.com may in its sole discretion add, delete or change some or all of its products and services at any time.
In the event of any changes in the Government increase in VAT we reserve the right to alter our prices accordingly.
The law of England governs these Terms & Conditions of use and you and we agree to use the English courts if there is any dispute between us.
If any part of these Terms & Conditions of use is found to be invalid by law, the rest of them remain valid and enforceable.
LIABILITY
The Customer will be responsible for ensuring the fitness for purpose of the Goods for the Customers application unless the purpose is previously notified to Forlan Networks.
To the extent permitted by law, Forlan Networks accepts no liability whatsoever or howsoever arising in respect of loss, damage or expense arising from errors in information or advice provided whether or not due to Forlan Networks negligence or that of its employees, agents or sub-contractors save for any loss or damage arising from death or personal injury.
To the extent permitted by law, Forlan Networks shall not be liable to the Customer by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of any Contract with the Customer, for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of Forlan Networks, its employees or agents or otherwise) which arise out of or in connection with the supply of the Goods or their use or resale by the Customer.
The entire liability of Forlan Networks under or in connection with the Contract with the Customer shall not exceed the price of the Goods except as expressly provided in these terms and conditions.
Force Majeure
Forlan Networks shall not be liable to the Customer or deemed to be in breach of Contract by reason of any delay in performing, or any failure to perform, any obligations of Forlan Networks in relation to the Goods, provided that the delay or failure was due to any cause beyond reasonable control of Forlan Networks. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond reasonable control of Forlan Networks: Act of God, explosion, flood, tempest, fire or accident; war or threat of war, sabotage, insurrection, civil disturbance or requisition; acts, restrictions, regulations bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority; import or export regulations or embargoes; strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of Forlan Networks or of a third party); difficulties in obtaining raw materials, labour, fuel, parts or machinery; power failure or breakdown in machinery.
ORDERING PROCESS
We shall acknowledge receipt of your order by email, however this is not an acceptance of your order.
The final price for the ordered Goods including postage costs and any VAT shall be confirmed to you by email when we accept your order.
We reserve the right to refuse any order.
PAYMENT
Full payment must be cleared before we dispatch your goods to you.
Receipts will not be sent out automatically. You may request a receipt for payment by calling our office.
We accept the following methods of payment: Visa, Visa Delta, Visa Purchasing, MasterCard, JCB, Switch, Visa Electron and Solo. Note - some banks do not allow certain debit cards to be used if the cardholders are not present, in particular Electron, Solo & Switch.
RETURNS
European Union Law
If you are not entirely satisfied with your goods you may return them within seven working days and request a full refund. We will gladly refund your transaction in full to the original credit card used at the time of purchase, as soon as we receive the unwanted goods. The goods must be undamaged and securely re-packaged. The cost of returning the goods will be your responsibility unless we sent you the goods by mistake or the goods were faulty. For products of high value we recommend you use recorded delivery, as you remain responsible for the products until such time that we receive them back
RETURNS PROCEDURE
When returning Goods you must have a Goods Return Merchandise Authorisation (RMA) number so that we are able to process your return. You need to contact us to obtain an RMA number and we will send you a form, which you will need to complete and return. The RMA number must be clearly shown on each returned parcel.
If you wish to return only part of your order, original postage costs will be recalculated if necessary.
FAULTY GOODS
Should you receive damaged goods, you have 30 days from dispatch to return the goods to us. The 30-day period starts the day you receive an email from us to say we have dispatched your order. We will replace the faulty goods or refund your transaction in full to the original credit card used at the time of purchase. In the event of receiving faulty goods we will cover the cost of the postage for returning the faulty goods back to us. Please follow the instructions in our Returns Procedure
CANCELLING AN ORDER BEFORE DISPATCH
If you change your mind after placing an order, you can cancel it at any time before we dispatch it. You will need to contact us with your details.
If you cancel part of an order the postage charge is recalculated on the price of the goods you keep. For example, if your order is for cable length over 20 metres and your chosen delivery option is normal next day delivery, the delivery cost would be £13.00. If you then cancel part of the order and it drops below 20 metres (and you still to use normal next day delivery) the cost of postage would drop to £7.50.
DELIVERY
If for any reason we cannot meet the delivery option chosen at the time of ordering, we will contact you to decide on a new delivery date. Your order will not be sent out until you have agreed with us to a new delivery date. If you do not agree with us to a new delivery date then we shall reimburse any payment made by you to us within 30 days.
Should we fail to meet an estimated delivery time due to matters outside our control, we shall not be liable for any expenses, costs, damages or direct or indirect losses incurred by you or any other person.
PRIVACY STATEMENT
Any information collected from you shall only be used lawfully in accordance with the Data Protection Act 1998.
Your details will not be passed on to any third parties and will only be used to process your order or to contact you to provide you with information that we think may be of interest to you. Please contact us if you do not wish your information to be used in this way.
We do not accept any liability for any external compromise of security or confidentiality in relation to transmissions sent by email.
All payments made through our website will go through to a secure area managed by Worldpay Ltd.
The personal information that we hold will be held securely in accordance with the law.
